August 24, 2015 Filing 10 MINUTES (IN CHAMBERS) by Judge Percy Anderson: Before the Court is plaintiff Greg Elofson's Ex Parte Motion Requesting Counsel #5 . Plaintiff, who filed this action pro se, brings the current Application in an attempt to procure legal representation. The United States civil court system does not guarantee a right to counsel. Plaintiff's filings in this action show that he is able to articulate his claim adequately. The issues involved in this case are not sufficiently complex. Moreover, because of significant questions concerning the appropriateness of venue in this Court, the apparent lack of personal jurisdiction over the defendants, and numerous potential inadequacies concerning the legal theories advanced by Plaintiff, Plaintiff is unlikely to achieve success on the merits. For all of the foregoing reasons, the Court therefore concludes that this case does not present exceptional circumstances. Accordingly, the Court denies Plaintiff's Ex Parte Application requestingcounsel. (smo)
August 21, 2015 Filing 8 MINUTES (IN CHAMBERS) by Judge Percy Anderson: Before the Court is an Ex Parte Application for Temporary Restraining Order filed by plaintiff Greg Elofson #3 , #4 . Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds that this matter is appropriate for decision withoutoral argument. Plaintiff has alleged no facts suggesting that this Courtpossesses personal jurisdiction over any of the defendants. Court finds that Plaintiff has failed to meet his burden to establish either a probability of success on the merits or even that he has raised a serious question with respect to his requested injunction. Even if there was any merit to Plaintiffs allegations, the Court additonally concludes that he has failed to establish, within the requirements of Local Rule 7-19.2, that the Court should issue the injunctive relief he seeks on an ex parte basis without notice to the defendants. For all of the foregoing reasons, the Court denies Mobley's Ex Parte Application for Temporary Restraining Order. The Court orders Plaintiff to show cause, in writing, why this action should not be dismissed for improper venue and lack of personal jurisdiction over defendants. Plaintiff's response to this order to show cause shall be filed no later than September 4, 2015. Failure to file a response to this order to show cause by that date, or to satisfactorily establish that this Court is the proper venue for this action,and that this Court possesses personal jurisdiction over the defendants, may result in the dismissal of this action without prejudice without further warning.
