February 23, 2016 Opinion or Order Filing 41 MINUTE ORDER IN CHAMBERS by Judge Percy Anderson. On February 1, 2016, the Court issued an Order to Show Cause why this action should not be dismissed because it appeared that plaintiffs Ingrid M. Carrillo and Maximo A. Arriola (collectively "Plaintiffs") had abandoned their case. (Docket No. #39 .) This Order to Show Cause was prompted by Plaintiffs' counsel's response to another Order to Show Cause issued on January 13, 2016. There, Plaintiffs' counsel explained that Plaintiffs had failed to participate in selecting a settlement officer because he had been unable to contact them for several weeks. (Docket Nos. #37 , #38 .) Plaintiffs' Response to the February 1, 2016 Order was due no later than February 15, 2016. To date, Plaintiffs have not filed a Response. Defendants and third party plaintiffs Alexandria Housing Partners, LP, Alexandria Group, LLC, Community Housing Assistance Program, Inc., and Barker Management, Inc. (collectively "Defendants and Third Party Plaintiffs") filed a Response requesting (1) dismissal of Plaintiffs' Complaint based on Plaintiffs' failure to respond and (2) dismissal of their Third Party Complaint because it is "entirely derivative of Plaintiffs Complaint." (Docket No. #40 .) Here, the Court cautioned Plaintiffs about the possibility of dismissal in the January 13, 2016 Order to Show Cause and in the February 1, 2016 Order to Show Cause. Accordingly, Plaintiffs' action is dismissed for failure to prosecute and for failure to comply with the Court's Orders. Per their request, Defendants and Third Party Plaintiffs' Third Party Complaint is dismissed without prejudice. IT IS SO ORDERED. (lom)
