Many, though not all, of the defendants named in the FAC have filed motions to dismiss a nd/or motions for a more definite statement 47 , 49 , 55 , 60 , 62 . Plaintiff has also filed two ex parte applications seeking an extension of time to oppose these motions 63 , 71 . In light of the Court's dismissal of the operative FAC, defendants' motions and plaintiff's pending ex parte requests are hereby DENIED AS MOOT.
