MINUTE ORDER IN CHAMBERS by Judge Percy Anderson: Before the Court is a Motion for Summary Judgment filed by plaintiff Travelers Property Casualty Company of America #34 . In its Motion for Summary Judgment, Travelers asserts that it has no duty to defend or indemnify defendant Medversant Technologies, LLC against claims brought under insurance policies it issued to Medversant arising out of litigation brought in both the Central District of California by Edward Simon,DC and in the Northern District of Illinois by Affiliated Health Care Associates, PC against Medversant. Travelers also seeks to recover from Medversant defense costs it has already expended while defending Medversant under a reservation of rights. While the parties have adequately addressed the issues related to whether the claims alleging violations of the TCPA and related state statutes are subject to the unsolicited communication exclusions contained in the CGL policies, the parties have not addressed the potential applicability of those exclusions, along with the E&O policy's consumer protection law exclusion, to the common law nuisance, conversion, and trespass to chattels claims alleged in AHCA's action. The Court therefore orders the parties to submit supplemental briefs addressing the potential applicability of the subject exclusions to those common law claims. The parties' supplemental briefs, which shall not exceed 12 pages, shall be filed no later than March 10, 2016. The hearing currently calendared for March 14, 2016, is vacated. The Court will deem the matter under submission after receiving the parties' supplemental briefs and inform the parties once it has either issued an order resolving Travelers' Motion or of the hearing date if the Court concludes that a hearing is necessary.
