MINUTES (IN CHAMBERS)Order Denying Without Prejudice Plaintiffs' Motion to Compel and Taking Hearing Off Calendar by Magistrate Judge Jean P. Rosenbluth: On April 27, 2018, Plaintiffs filed a motion to compel further discovery responses, setting it for hearing on May 31. In light of the District Judge's May 23 order granting Defendants' motion for judgment on the pleadings, the motion to compel is moot. But because the District Judge granted Plaintiffs leave to amend, the Court denies the motion without prejudice. Accordingly, the hearing scheduled for May 31 is ORDERED OFF CALENDAR. #44 (bem)

Gutierrez: Before the Court is a motion for judgment on the pleadings filed by Defendants Soheil Ahaddian, M.D. and Soheil Ahaddian, M.D., P.C. (Defendants). See Dkt. #42 (Mot.). Qui Tam Plaintiffs Britt Karp and Jasper Posner (Relators) oppose the motion, see Dkt. #45 (Opp.), and Defendants replied, see Dkt. #46 (Reply). The Court finds the matter appropriate for decision without oral argument. See Fed. R. Civ. P. 78; L.R. 7-15. Having considered the moving papers, the Court GRANTS Defendants motion. (SEE DOCUMENT FOR FURTHER DETAILS). For the foregoing reasons, the Court GRANTS Defendants motion for judgment on the pleadings as to Relators first and second causes of action under the FCA. Because the Court also GRANTS Relators leave to amend, an amended complaint must be filed by June 22, 2018. Failure to file an amended complaint by that date will result in dismissal of Relators FCA claims with prejudice. IT IS SO ORDERED. (ab)
