Gutierrez: Before the Court is a motion for judgment on the pleadings filed by Defendants Soheil Ahaddian, M.D. and Soheil Ahaddian, M.D., P.C. (Defendants). See Dkt. #42 (Mot.). Qui Tam Plaintiffs Britt Karp and Jasper Posner (Relators) oppose the motion, see Dkt. #45 (Opp.), and Defendants replied, see Dkt. #46 (Reply). The Court finds the matter appropriate for decision without oral argument. See Fed. R. Civ. P. 78; L.R. 7-15. Having considered the moving papers, the Court GRANTS Defendants motion. (SEE DOCUMENT FOR FURTHER DETAILS). For the foregoing reasons, the Court GRANTS Defendants motion for judgment on the pleadings as to Relators first and second causes of action under the FCA. Because the Court also GRANTS Relators leave to amend, an amended complaint must be filed by June 22, 2018. Failure to file an amended complaint by that date will result in dismissal of Relators FCA claims with prejudice. IT IS SO ORDERED. (ab)
