Consistent with the order made during the June 27, 2016 hearing, the parties shall file a Joint Report on or before July 7, 2016, in which they state their collective and/or respective views as to the following issues: (i) an agreed upon settlement method in this action, and the status of that process; (ii) the most efficient manner in which to proceed with this action in light of the pending arbitration in the Philippines where certain parallel issues apparently have been presented; (iii) whether Defendants intend to file a motion to compel arbitration and the anticipated dat e of its filing; and (iv) what discovery Plaintiff seeks regarding arbitrability should Defendants bring a motion to compel arbitration, and the expected amount of time to complete such discovery so that a response to a motion to compel can be presented. Upon review of the Joint Report, the Court will set further dates in this matter, which may include those that would apply in the event that the matter is not remanded or arbitrated. (pso) |
