ORDER RE REQUEST TO PROCEED IN FORMA PAUPERIS by Judge Andre Birotte Jr.: Denying #3 REQUEST to Proceed in Forma Pauperis. IT IS FURTHER ORDERED that this case is hereby DISMISSED. IT WAS RECOMMENDED that the Request to Proceed In Forma Pauperis be DENIED by Magistrate Judge Gail J. Standish. Reasons: Inadequate showing of indigency. Immunity as to all Defendants. No in forma declaration for Plaintiff Shorter; neither Plaintiff signed the Complaint; one pro se Plaintiff may not represent the other; and failure to state a claim upon which relief can be granted. No cognizable Section 1983 claim is stated for either Plaintiff. A Section 1983 claim may not be premised on an alleged ADA violation. Defendants are federal officials/employees sued for damages and in their official capacities only and, thus, the Complaint is barred by sovereign immunity. As a pro se litigant, Plaintiff Callier may not represented Plaintiff Shorter. The Complaint is signed by a "Willie L. Banks," who is not a party or Plaintiffs' counsel, in violation of Fed. R. Civ.
