Unicolors shall recover costs from Zulily in the amount of $1,500.00.The offer of compromise was for purposes of settlement only. November 23, 2016 Opinion or Order Filing 18 JUDGMENT by Judge Otis D. Wright, II1: Unicolors shall recover from Zulily the amount of Two Hundred Dollars ($200.00) with the costs accrued as of the making of the Rule 68 offer; 2. The amount of costs will be determined by mutual agreement of the parties following acceptance of the Rule 68 offer or, if the parties cannot agree, in an amount to be determined by the Court. If the parties cannot agree on the amount of costs, reasonable attorneys fees may be awarded as part of the costs only if (1) the Court determines that Plaintiff is the prevailing party; and, (2) in its discretion after consideration of all relevant factors, the Court determines that an award of reasonable attorneys fees is appropriate in this case. The amount of co sts and attorneys fees (ifapplicable) shall not include costs that are fairly attributable to Plaintiffs claims against parties other than Zulily and claims against Zulily which were previously settled; 3. The offer of compromise was for purposes of settlement only. This judgment shall not constitute an admission of any wrongdoing by Zulily. This offer shall not have preclusive effect with respect to the truth or falsity of any partys allegations.
