Filing 48 JUDGMENT by Judge Fernando M. Olguin. IT IS HEREBY ADJUDGED that: 1. The Petition to Approve Compromise of a Disputed Claim (Document No. 41 ), as amended by the Amendment to Petition for Order for Approval of Compromise (Document No. 43 ), is gr anted as set forth herein. The proposed order submitted with the Amendment to Petition for Order for Approval of Compromise (Document No. 43 -1) will be issued by the court. 2. The court hereby grants final approval to the parties' Settlement Agreement (Settlement Agreement) (Document No. 45 -1). The court finds that the settlement is fair and reasonable and serves the best interests of Mr. Hart. The parties are ordered to perform their obligations pursuant to the terms of the Settle ment Agreement and this Order. 3. Plaintiffs Ex Parte Application to Waive Bond Requirement Under Local Rule 17-1.7(Document No. 42 ) is granted. The bond requirement in Local Rule 17-1.7 is hereby waived. 4. Plaintiff James Mitchell Hart shall be paid $273,564.10, to be deposited into a blocked account. The court will issue the proposed orders (Document Nos. 43 -1 & ]44]-1) submitted by the parties. Withdrawals of the principal or interest may be made from the blocked account by con servator Roxsana Hart, as ordered by the state court. 5. Plaintiff Roxsana Hart shall be paid $273,564.10, in accordance with the terms of the Settlement Agreement. 6. Plaintiff's counsel shall be paid $333,333.33 in attorney's f ees and $21,553.46 in costs in accordance with the terms of the Settlement Agreement. 7. This action is dismissed with prejudice, with all parties to bear their own fees and costs except as set forth herein. (lom) (Main Document 48 replaced on 11/27/2017) (lom). |
Filing 37 ORDER DISMISSING ACTION WITHOUT PREJUDICE by Judge Fernando M. Olguin that the above-captioned action is hereby dismissed without costs and without prejudice to the right, upon good cause shown within 45 days from the filing date of this Order, to re-open the action if settlement is not consummated.
