As a result, the Court dismisses this action without prejudice su bject to either party reopening the action on or before 3/9/2018. The Court will retain jurisdiction for the sole purpose of enforcing the settlement until 3/9/2018. Thereafter, absent further order of the Court, the dismissal of this action will be with prejudice. ORDER TO SHOW CAUSE WHY SANCTIONS SHOULD NOT BE IMPOSED FOR FAILURE TO COMPLY WITH THE COURT'S ORDER by Judge John F. Walter. Defendant, Mindy Hampton, is ordered to show cause in writing by November 8, 2017 why the Court should not impose san ctions in the amount of $1,500.00 against her counsel or why the Court should not strike her Answer and enter default judgment for violating of the Court's CMO. No oral argument on this matter will be heard unless otherwise ordered by th e Court. See Fed. R. Civ. P. 78; Local Rule 7-15. The Order to Show Cause will stand submitted upon the filing of the response to the Order to Show Cause. Failure to respond to the Order to Show Cause will result in the imposition of sanctions and entry of default judgment against Defendant Mindy Hampton. IT IS SO ORDERED. (jloz)
