Snyder: The Court hereby enters judgment in favor of Plaintiff Zhang Xudong and against Defendants Hung Ern Toh, Barr Holdings, LLC and Barr Consulting & Holdings, Inc., jointly and severally, as follows: Defend ants Hung Ern Toh, Barr Holdings, LLC and Barr Consulting andHoldings, Inc. are adjudged liable for fraud; and The Court awards to Plaintiff Zhang Xudong damages in the amount of $261,072.90, which consists of $259,780.00 in compensatory damages and costs in the amount of $1292.90, as well as post-judgment interest from the date of entry ofthe Judgment until paid.. The Court DISMISSES without prejudice plaintiff's first, second, third, fourth, and sixth claims with respect to Toh and Flecke. The Cou rt DISMISSES without prejudice plaintiff's first, second, third, and sixth claims as against Barr Consulting and Holdings, Inc., Demarest, and Architects. The Court DISMISSES without prejudice plaintiff's second claim against Barr Holdings, LLC. The Court DISMISSES without prejudice plaintiff's fourth claim as against Demarest and Architects. The Court DENIES defendants' motion to dismiss plaintiff's fourth claim as against the Barr Entities. The Court DENIES defendants& #039; motion to dismiss plaintiff's first, third, and sixth claims as against Barr Holdings, LLC. The Court DISMISSES without prejudice plaintiff's fifth claim against Flecke. Plaintiff is hereby granted 28 days leave to file an amended com plaint curing the deficiencies identified herein. Failure to amend within 28 days of the date of this order may result in dismissal with prejudice. The Court further sets a Telephonic Status Conference for 10/2/2017 12:00 PM before Judge Christina A. Snyder, to discuss status of the case. Counsel for PLAINTIFF is ordered to initiate the telephone conference call THROUGH THE TELEPHONE OPERATOR to include all counsel of record, and CHAMBERS on the date and time scheduled.
