Filing 19 MINUTES (IN CHAMBERS) ORDER DENYING PLAINTIFF'S MOTION FOR ORDER REMANDING CASE TO STATE COURT 10 by Judge Philip S. Gutierrez. Before the Court is a motion for order remanding case to state court filed by Plaintiff Tinamarie Fatiah Al-Najjar (Plaintiff). See Dkt. # 10 (Mot.). Defendant Kindred HealthcareOperating, Inc. (Defendant) opposes the motion, see Dkt. # 16 (Opp.), and Plaintiff timely filed a reply, see Dkt. # 17 (Reply). The Court finds the matter appropriate for decision witho ut oral argument. See Fed. R. Civ. P. 78(b); L.R. 7-15. Having considered the moving papers, the Court DENIES Plaintiffs motion. (SEE DOCUMENT FOR FURTHER DETAILS). Because the Court concludes that Defendant has demonstrated by a preponderance of the evidence that the $5 million CAFA amount in controversy requirement is met here, and thus that the Court has subject matter jurisdiction over this action, it DENIES Plaintiffs motion for order remanding case to state court.
