Filing 8 MINUTES (IN CHAMBERS) Order to Show Cause re: Dismissal for Lack of Prosecution by Magistrate Judge Douglas F. McCormick. Plaintiff did not file a First Amended Complaint by the deadline. Nor has Plaintiff sought any extension of time in which to do so. Plaintiff's failure to take any action with respect to his case evidences a failure to prosecute. Accordingly, on or before June 29, 2018, Plaintiff is ORDERED to show good cause in writing why the Court should not dismiss this action for failure to prosecute. In his response, Plaintiff should also give the Court additional details to support his "Request for Order," explaining what mental disability he suffers from, how it affects his ability to pursue this case (especi ally given that he appears to have written a coherent although legally deficient complaint), what law library access he currently has, and what law library access he believes he needs. Plaintiff is expressly warned that if he fails to file a timely response to this Order, the Court may recommend dismissal of this action for lack of prosecution. (see document for details). (dro) |
Filing 7 MEMORANDUM AND ORDER DISMISSING COMPLAINT WITH LEAVE TO AMEND by Magistrate Judge Douglas F. McCormick. If Plaintiff still desires to pursue his claims against Defendants, he shall file a First Amended Complaint within thirty-five (35) days of the date of this Order remedying the deficiencies discussed above. Plaintiff is admonished that, if he fails to timely file a First Amended Complaint, the Court will recommend that this action be dismissed with prejudice for failure to diligently prosecute. (twdb) |
