Filing 26 MINUTES IN CHAMBERS COURT ORDER by Judge Percy Anderson. For all of the foregoing reasons, DLI's Motion to Dismiss Complaint Pursuant to Rule 12(b)(1) and Rule 12(b)(6) is granted. Although only DLI has moved for dismissal, the Court must di smiss an action if it determines at any time that it lacks subject matter jurisdiction. Fed. R. Civ. P. 12(h)(3). Because the Court concludes that it lacks subject matter jurisdiction, the Court dismisses this action without prejudice. Plaintiff's Motion for a Preliminary Injunction 9 10 is denied as moot.
