Filing 72 CONSENT JUDGMENT AND ORDER by Judge Otis D. Wright, II. Defendants shall not fail to disgorge, from the gross proceeds of their having sold or shipped in commerce goods that had been worked on by employees of Aqua Fashion, Inc., JE Apparel, Inc., Sung Hee Park dba as Super Seam, Inc., SC Style, Inc., HJ Fashion, Inc., KBKB Fashion, Inc., All is Well, Inc., Keep in Touch TS, Inc., and BSY Fashion, Inc. who were not paid the minimum wage and overtime required by the FLSA, 29 U.S.C. § 167; 206 and 207, an amount sufficient to cover the back wages due to these employees under the FLSA. The amount hereby found due to these employees is $357,993.81. It is further ORDERED that each party shall bear its own fees and other expenses incurred by such party in connection with any stage of this proceeding, including but not limited to attorneys' fees. Filing 26 PRELIMINARY INJUNCTION by Judge Otis D. Wright, II: Defendants Aqua Fashion, Inc. AND JE Fashion, Inc. are enjoined from shipment of all goods for 2 weeks to allow Secretary to determine that goods were produced in compliance with the FLSA. Defendant s are enjoined and restrained from shipment of all Ginger G goods until Ginger G provides sufficient records to allow the Secretary to determine, and the Secretary does determine, that goods were produced in compliance with the FLSA. Defendant Chang Lee shall be available for deposition within two weeks of the time that Ginger G has produced all records to the Secretary. Defendants Ginger G, Chang Lee, Hae Lee, and Hye Kyung Lee are enjoined and restrained from using domestic sewing contractors toproduce Ginger G goods until they confirm that the contractor pays employees for all hours worked, regular and overtime, at the rates prescribed by law.
