December 26, 2018 Opinion or Order Filing 18 (IN CHAMBERS) ORDER CONTINUING ORDER TO SHOW CAUSE RE DISMISSAL FOR LACK OF PROSECUTION (DKT. 9 11 ) by Judge John A. Kronstadt: This case was filed on August 16, 2018. Dkt. #1 . On November 18, 2018, the Court issued an Order to Show Cause re Dismissal for Lack of Prosecution for Plaintiff's failure to file a proof of service indicating that Defendants were served with the summons and Complaint (the "OSC"). Dkt. 9 . Plaintiff filed a timely response to the OSC. The Proof of Service states that Defendants were served with the summons and Compliant on October 21, 2018, causing the response to the Complaint to be filed on or before November 13, 2018. Dkt. #10 . Defendants did not file a response to the Complaint. Accordingly, the Court continued the OSC to December 10, 2018, to permit Plaintiff the opportunity to file a request for the entry of default. Dkt. 11 . On December 7, 2018, Plaintiff filed a Request for the Entry of Default (Dkt. #12 ) (the "Request"). Plaintiff withdrew the Request on the same date. Dkt. #13 #14 . Plaintiff failed to file a timely response to the OSC. However, on December 19, 2018, Plaintiff filed a First Amended Complaint (the "FAC"). Dkt. #15 . The Court will accept the late-filed FAC. However, Plaintiffs shall serve the FAC on Defendants and file a proof of service no later than January 9, 2019. This case has been pending for four months and this is the third time the Court has had to continue the OSC due to Plaintiff's failure to adhere to the Local Rules with respect to the deadlines. Moreover, it is not an efficient use of judicial resources. There will be no further continuances of this matter. December 3, 2018 Opinion or Order Filing 11 (IN CHAMBERS) ORDER CONTINUING ORDER TO SHOW CAUSE RE DISMISSAL FOR LACK OF PROSECUTION (DKT. 9 ) by Judge John A. Kronstadt: The Court issued an Order to Show Cause for Lack of Prosecution on November 18, 2018 (Dkt. 9) (the "OSC"). Plaintiff was directed to file a proof of service by November 30, 2018, showing that Defendant was served with the Complaint and initiating documents. The Proof of Service states that Defendant was served with the Complaint and initiating documents on October 21, 2018. Dkt. #10 .
