MINUTES (IN CHAMBERS) ORDER DENYING WITHOUT PREJUDICE PLAINTIFFS' MOTION FOR EMERGENCY WRIT OF MANDAMUS AND PRELIMINARY INJUNCTION #2 AND EX PARTE APPLICATION FOR A PRELIMINARY INJUNCTION #3 by Judge Dolly M. Gee: Accordingly, the Court DENIES, without prejudice, Plaintiffs' Ex Parte Application and Motion for Emergency Writ of Mandamus and Preliminary Injunction. Because further briefing regarding a preliminary injunction or writ of mandamus is not warranted, the Court DENIES without prejudice Plaintiffs' request that the Court issue an order to show cause why a preliminary injunction or writ of mandamus should not issue. This Order in no way precludes Plaintiffs from filing suit against Defendants in an appropriate venue. Additionally, the Court ORDERS Plaintiffs to show cause why, given this Court's ruling that venue is improper, this action should not be dismissed forthwith, without prejudice. Plaintiffs shall file their response, or voluntarily dismiss this matter, by September 21, 2018. Defendants may file an optional reply to Plaintiffs' response by September 26, 2018.
