MINUTE Order Denying Request to Proceed In Forma Pauperis (IN CHAMBERS) by Magistrate Judge Sheri Pym RE: #4 REQUEST for Leave to Proceed without Prepayment of Filing Fee. Based on petitioner's declaration in support of request to proceed in forma pauperis (docket no. 4, filed October 5, 2018), petitioners request to proceed in forma pauperis is DENIED. Petitioner must pay the $5.00 filing fee on or before November 13, 2018, if he wishes to proceed with this case. But he need not do so if he intends to voluntarily dismiss this case, or if he otherwise agrees with the court's assessment in the October 5, 2018 Order to Show Cause Why Petition Should Not Be Recharacterized as a 2255 Motion and Dismissed. If petitioner fails to timely pay the $5 filing fee, this action will be subject to involuntary dismissal for failure to comply with a court order. See Fed. R. Civ. P. 41(b). (iva)
