August 1, 2019 Filing 47 MINUTES OF Telephone Conference held before Magistrate Judge Gail J. Standish regarding Status of Discovery and Follow-up. On July 30, 2019, the Court conferred with counsel regarding the documents produced by defendant for in-camera review. The Court advised counsel that upon review of the in-camera documents, which essentially detail the activation of the plan administrator and set forth the administrator's duties under the plan, the Court found that the documents fall within the ambit of the fiduciary exception to the asserted privileges. Given that the discovery cutoff had already passed, the Court conferred with the District Judge, the Honorable Dolly Gee, who permitted the Court to order production of these specific documents. The Court thus ordered that the email chain be produced to plaintiff's counsel, but stayed the order pending notification to the Court by defense counsel by 4:00 pm on Thursday, August 1, 2019 whether Defendant intended to seek review of the Court's order by the District Judge.
