August 1, 2019 Opinion or Order Filing 42 (IN CHAMBERS) ORDER IMPOSING SANCTIONS ON PLAINTIFF'S COUNSEL (DKT. #37 ) by Judge John A. Kronstadt: On 7/18/2019, an Order to Show Cause Why Sanctions Should Not Be Imposed (the "OSC" (Dkt. 37)) issued due to certain inaccurate representations by Plaintiff's counsel in an ex parte application (Dkt. #35 ) and supporting declaration (Dkt. 35-1). The OSC set forth the statements about the relevant chronology of events at issue, as well why they were inaccurate. See Dkt. 37 at 1-2. The accurate chronology was verified based on the public docket. The OSC directed Plaintiff's counsel to submit a declaration under penalty of perjury addressing these matters, and why monetary sanctions of $250 should not be imposed. For these reasons, which resulted in a misallocation of judicial resources, monetary sanctions of $250 are warranted, and imposed against Shahbod D. Kerendian and Tom N. Tran, who are jointly and severally liable for their payment. They shall be paid to the Clerk within 14 days of the issuance of this Order. Accordingly, if Plaintiff would like Wolan and McCain reinstated as defendants in this action, Plaintiff shall file both (i) compliant proofs of service as to each Wolan and McCain; and (ii) a new application seeking relief from the order of dismissal.
