CV 19-01246 (BRADLEY SMITH) SHOULD NOT BE REMOVED FROM THE MDL by Judge Andre Birotte Jr. The Court has reviewed Plaintiff Bradley Smith's (Plaintiff) objection to the inclusion of his case in the In Re Ford Motor Co. DPS6 Powershift Transmission Products Liability Litigation MDL. Briefly, Plaintiff contends that his case concerns alleged defects in a 2018 Ford Fiesta, a vehicle model from a year that is not included in the MDL, which was established to adjudicate actions involving model year 2011-2016 Ford Fiestas. Defendant is therefore ORDERED TO SHOW CAUSE why this action should not be removed from the MDL. Defendant must file a Response to this OSC no later than March 11, 2019, and Plaintiff may file a Reply no later than March 18, 2019. (lom)
