Summary adjudication is GRANTED in Pro-Com's favor as to the issues of McCormick's collusion, the lack of prejudice to Harleysville resulting from the insureds' purported breaches of the Policy, and whether the chargeback fees that Pro-Com incurred qualify as "contractual penalties" under the Policy. The MSJ is DENIED in all other respects. Harleysville's requests for Rule 11 sanctions against Pro-Com and a Rule 56(d) continuance of summary judgment proceedings are also DENIED. The Court DENIES the MDQ in full and ORDERS Pro-Coms counsel to show cause why he personally should not have to pay Harleysville's reasonable attorneys' fees incurred in responding to the MDQ. Pro-Com's counsel shall respond to the Order to Show Cause, in writing not to exceed 10 pages, by 7/20/2020. (jp) |
