June 6, 2019 Opinion or Order Filing 77 MINUTES (IN CHAMBERS) - COURT ORDER by Judge Percy Anderson re: #19 Motion to Exclude; #28 Motion to Exclude. The Court has reviewed the briefing on the "Omnibus" Motion to Exclude Defendant's Expert Witnesses and the "Second" Motion to Exclude Defendant's Expert Witnesses filed in both of these actions while they were still pending in the MDL Court. The MDL Court did not rule on either of those Motions before the actions were transferred to this Court. The counsel involved in these actions are engaged in numerous such cases and have a substantial understanding of the positions and opinions that these expert witnesses are likely to possess. Under these circumstances, the Court concludes that the situation does not justify the striking or exclusion of defendants expert witnesses and that defendant's failure to timely disclose its expert witness was substantially justified or harmless. The Court therefore denies plaintiffs' Motions to Exclude Defendant's Expert Witnesses. The parties shall, no later than 12:00 p.m. on June 12, 2019, file a further status report detailing the specific claims and defenses (including affirmative defenses) that they intend to present in the trials of these actions.
