MINUTES OF IN CHAMBERS - ORDER DISMISSING ACTION WITHOUT PREJUDICE FOR LACK OF SUBJECT MATTER JURISDICTION by Judge Dolly M. Gee: On 5/21/2019, the Court ordered Plaintiff Peter M. Seltzer to show cause why this action should not be dismissed for lack of subject matter jurisdiction and improper venue ("OSC") #7 . In lieu of a response to the OSC, Plaintiff filed a Notice of Dismissal of his claims against only Defendants Calvada Partners, LLC and ACC Enterprises, LLC #8 . Yet, the jurisdictional concerns raised in the OSC were not limited to those two Defendants. Plaintiff bore the burden of establishing that jurisdiction is proper. As Plaintiff failed to discharge that burden, the Court DISMISSES this action without prejudice for lack of subject matter jurisdiction. (Made JS-6. Case Terminated.) Court Reporter: Not Reported.
