Filing 15 Text Entry Order: Based on the Courts review of the Joint Statement Regarding Conference of Counsel Pursuant to Local Rule 7-3 Regarding AQ Textiles LLCs Motion to Dismiss filed July 29, 2019 (Docket No. #14 ), the Court concludes that Plaintiffs counsel has a fundamental misunderstanding of Local Rule 7-3 and the Courts Standing Order which provides in relevant part: These principles require counsel for the plaintiff to carefully evaluate the defendant's contentions as to the deficiencies in the Complaint, and in most instances, the moving party should agree to any amendment that would cure a curable defect. Counsel should, at the very least, resolve minor procedural or other nonsubstantive matters during the conference. Standing Order, 5(b). Plaintiffs counsel apparently believes that he can defer making a decision on dismissal or amendment until some undetermined date in the future which defeats the purpose of Local Rule 7-3. Accordingly, Plaintiffs counsel shall file a Declaration on July 31, 2019 setting forth Plaintiffs position as to each issue discussed at the Local Rule 7-3 conference and state whether he will dismiss or amend any of the Plaintiffs claims.THERE IS NO PDF DOCUMENT ASSOCIATED WITH THIS ENTRY.
