MINUTES (IN CHAMBERS) ORDER STRIKING ANSWER by Judge Andre Birotte Jr.: On 7/25/2019, an Answer was filed by Jose Zarate and Jose Zarate Jr., pro se, on behalf of Defendant Lucky Guys LLC #12 . However, neither Jose Zarate nor Jose Zarate Jr. are named as defendants in this case. In addition, as they are not attorneys, they cannot appear on behalf of the entity defendant Lucky Guys LLC, which must be represented by an attorney. Accordingly, the Court STRIKES the Answer. Lucky Guys LLC's deadline to file an Answer is hereby EXTENDED to 9/28/2019. The Court also strongly urges the Defendants to consider participating in the Court's Early Mediation Program for disability access claims under the ADA. Lucky Guys LLC does not need to be represented by counsel to participate in the Program. The Court hereby ORDERS Plaintiff to IMMEDIATELY serve on all Defendants this Order and all materials filed as Dkt. No. #8 , and to file proofs of service no later than 8/23/2019. The Court hereby informs Defendants that if they wish to participate in the ADA Early Mediation Program, they must file their Application for Stay within 14 days of receiving it. If the stay is granted, Lucky Guys LLC will not need to file an Answer for as long as the stay remains in place. Cases are often resolved in the ADA Early Mediation Program and the case ends without a defendant having to file an Answer. Court Reporter: N/A. (gk)
