Filing 20 (IN CHAMBERS) ORDER RE PLAINTIFF'S REQUEST FOR CLERK TO ENTER DEFAULT AGAINST DEFENDANTS (DKT. #17 ) AND DEFENDANTS ANSWER (DKT. #18 ) by Judge John A. Kronstadt: On August 20, 2019, Plaintiff filed a proof of service stating that the summons and Complaint were served on Defendants on June 20, 2019. Accordingly, Defendants' response to the Complaint was due no later than July 11, 2019. Dkt. #16 . On August 20, 2019, Plaintiff filed a request seeking entry of default (Dkt. #17 ) (the "Request"). That same day, Defendants filed their Answer (Dkt. #18 ) (the "Answer"). The Clerk did not enter default because the Answer was filed. The matter is referred to this Court. Dkt. #19 . The Answer is 40 days late. Fed. R. Civ. P. 6 provides that a court may, for good cause shown, accept a late response or motion made after the time has expired if the party failed to act because of excusable neglect. To streamline the proceedings in this matter, on or before August 30, 2019, and Pursuant to L.R. 7.3, the parties shall meet and confer to determine whether they will stipulate to the late filed Answer as a response to the Complaint. If they agree to such a stipulation, it shall be filed by September 3, 2019. If they do not agree to such a stipulation, then Defendants shall file a declaration by September 3, 2019. The declaration shall present any evidence as to the excusable neglect that was the reason for Defendants' failure timely to file a response to the Complaint.
