ORDER RE REQUEST TO PROCEED IN FORMA PAUPERIS by Judge John A. Kronstadt that the request to Proceed In Forma Pauperis #2 is hereby DENIED. IT IS RECOMMENDED by Magistrate Judge Jacqueline Chooljian for the following reasons: (1) Frivolous, malicious, or fails to state a claim upon which relief may be granted. (2) Leave to amend would be futile.(3) This denial may constitute a strike under the "Three Strikes" provision governing the filing of prisoner suits. See O'Neal v. Price, 531 F.3d 1146, 1153 (9th Cir. 2008). This is the latest in a series of frivolous actions filed by plaintiff. See, e.g., CDCA Case Nos. 2:16-cv-5554, 2:16-cv-7398, 2:16-cv-7954, 2:17-cv-5412; Ninth Circuit Case Nos. 11-15264, 16-56676, 17-35956.
