The Complaint filed in this action asserts a claim for injunctive relief arising out of an alleged violation of the Americans with Disabilities Act ("ADA") and a claim for damages pursuant to California's Unruh Act. Because the Court possesses only supplemental jurisdiction over the Unruh Act claim, and in light of California's statutory efforts to curtail such claims, the Court ordered plaintiff to show cause in writing why the Court should exercise supplemental jurisdiction over the Unruh Act claim asserted in the Complaint. See 28 U.S.C. 1367(c)(2) & (c)(4). Despite a statement in the Court's Order to Show Cause warning plaintiff that "[f]ailure to timely or adequately respond to this Order to Show Cause may, without further warning, result in the... Court declining to exercise supplemental jurisdiction over the Unruh Act and other state law claims," (Docket No. 10), Plaintiff did not file a timely response to the Court's Order to Show Cause. For all of the foregoing reasons, the Court, in its discretion, declines to exercise supplemental jurisdiction over plaintiff's Unruh Act claim.
