The Court is in receipt of a request for a temporary restraining order by John Lake ("Plaintiff") to prevent the California Department of Corrections and Rehabilitation from transferring him from "one prison to the next." Plaintiff makes a myriad of other allegations and legal claims in his Complaint, many of which have been alleged in the multitude of related actions initiated by Plaintiff. None of those claims seem to be of the type that would warrant preliminary relief, as they primarily concern claims of alleged past wrongs by prison employees at prisons where Plaintiff is no longer being housed. Moreover, Plaintiff's Complaint is not sufficient to establish any likelihood of success on the merits, on any of his claims. Thus, the Court would DENY Plaintiff's request for a temporary restraining order. (mrgo) |
