Wright, II: Pursuant to the Courts November 9, 2021 Order #92 and its December 6, 2021 Minute Order #101 , it is hereby ORDERED,ADJUDGED, and DECREED as follows 1. Plaintiff Rose McGowan shall take nothing from Defendants Harvey Weinstein; David Boies; Boies Schiller Flexner, LLP; Lisa Bloom; The Bloom Firm; and B.C. Strategies Ltd. on her first claim for Violations of the Racketeering Influences and Corrupt Organizations Act. 2. Plaintiffs RICO claim is DISMISSED ON THE MERITS AND WITH PREJUDICE as against all Defendants. 3. The Court declines to exercise supplemental jurisdiction over the remainder of the case and accordingly DISMISSES all remaining claims in this action WITHOUT PREJUDICE. Wright, II: Pursuant to the Courts November 29, 2021 Minute Order #100 , Plaintiff had until December 2, 2021, to apply for leave to file electronically, or, if not, until December 3, 2021, to file a supplemental brief in accordance with the instructions in the Courts November 9, 2021 Order, As of todays date, Plaintiff has not filed any brief in response to the Courts Order and Minute Order. Accordingly, Plaintiff is deemed to have conceded the two points the Court gave her opportunity to argue in the supplemental brief. Accordingly, the Court concludes that Plaintiff is unable to sufficiently plead a RICO claim, meaning that further amendment would be futile. Accordingly, the Court DISMISSES Plaintiffs RICO claim on the merits and with prejudice as against all Defendants and DISMISSES the remainder of the action without prejudice. November 29, 2021 Opinion or Order Filing 100 MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: Order GRANTING Request to Withdraw as Attorney #99 and SETTING Plaintiff's Deadlines. Ordinarily, the Court would not allow a represented party to proceed unrepresented at a key juncture in the proceedings such as this. However, counsel declares that Plaintiff has revoked counsel's authority to represent her. Plaintiff shall proceed self-represented. Counsel is requested to immediately transmit a copy of this Minute Order to Plaintiff. Individuals proceeding self-represented are bound by Federal Rules of Civil Procedure, the Central District of California Local Rules1, and the ODW Courtroom Rules. Counsel informs the Court that, consistent with counsel's professional responsibilities and ethical obligations, counsel both (1) transmitted to Plaintiff a copy of the Court's November 24, 2021 Minute Order and (2) provided Plaintiff with a copy of the supplemental brief counsel intended to file but did not (and which was due November 24, 2021). All this being so, Plaintiff understands that, given the state of the proceedings, terminating her relationship with her counsel does not, in and of itself, provide her with additional time to meet the Court's deadlines. Additionally, Plaintiff is aware that her supplemental brief was due November 24, 2021, and that the brief was important. The fact is that Plaintiff has now missed that deadline, represented or not. Nevertheless, the Court will provide Plaintiff with an opportunity to file her supplemental brief. If, pursuant to Local Rule 5-4.1.1, Plaintiff wishes to file an ex parte request for leave to file electronically, Plaintiff has until the end of the day on December 2, 2021 to enter her appearance and do so, and in that case the Court will, via Minute Order, set deadlines for Plaintiff to register on CM/ECF and to electronically file her supplemental brief. If Plaintiff does not make such a request, then Plaintiff has until December 3, 2021 to file her supplemental brief in paper format. C.D. Cal. L.R. 5-4.2. The supplemental brief shall address the two topics indicated at the end of the Courts November 9, 2021 Order. The brief shall also demonstrate why there is good cause to allow Plaintiff to file a late supplemental brief, given that the deadline to file the supplemental brief has passed. McGowan's second claim is DISMISSED as against all Defendants. The Court DEFERS determining whether to grant these two latter dismissals with or without leave to amend. The Court DEFERS ruling on the remainder of the Motions to Dismiss and ORDERS the parties TO SHOW CAUSE, in writing only, as follows. No later than fourteen (14) days from the date of this Order, McGowan shall file a Supplemental Brief indicating (1) how, if at all, she intends to amend her substantive RICO claim against Weinstein and the Boies Defendants and her RICO conspiracy claim against all Defendants; and (2) if the Court ultimately dismisses all RICO claims without leave to amend, why the Court should exercise supplemental jurisdiction over the remaining state-law claims. The Supplemental Brief may be up to eight (8) pages.
