ORDER DECLINING TO EXERCISE SUPPLEMENTAL JURISDICION OVER PLAINTIFF'S UNRUH ACT AND OTHER STATE LAW CLAIMS by Judge Cormac J. Carney. The Court declines to exercise supplemental jurisdiction over Plaintiff's Unruh Act, California's Disabled Persons Act, Health and Safety Code Section 19955, and negligence claims. These claims are hereby DISMISSED WITHOUT PREJUDICE to Plaintiff asserting them in state court. The Court retains jurisdiction over Plaintiff's ADA claim. (iv)

Carney: The Court ORDERS Plaintiff to show cause as to why it should not decline to exercise supplemental jurisdiction over his Unruh Act and other construction-related accessibility state law claims for similar reasons. Plaintiff shall file a response to this Order to Show Cause by December 9, 2019. In his response, Plaintiff shall identify the amount of statutory damages he seeks to recover. Plaintiff and his counsel shall also include declarations in their responses which provide all facts necessary for the Court to determine if they satisfy the definition of a high-frequency litigant under California Civil Procedure Code Sections 425.55(b)(1) & (2).
