Wilson re: EX PARTE APPLICATION for Temporary Restraining Order as to Defendant filed by Plaintiffs #6 - Plaintiffs motion for a temporary restraining order is DENIED. Plaintiff has not adequately demonstrated an appropriate likelihood of irreparable harm to receive injunctive relief. See Winter v. Natural Resources Defense Council, Inc., 555 U.S. 7, 20 (2008). Plaintiffs motion appears to focus solely on money damages stemming from an alleged breach of contract, based on the outcome of a pending asset sale in a Chapter 11 bankruptcy case that would allegedly render a related entity insolvent. But Plaintiff allegedly has a breach of contract claim against both a foreign entity and a US-based corporation that is currently in Chapter 11 bankruptcy. Plaintiff has not articulated why recovery via participation in the bankruptcy process is precluded. Moreover, because Plaintiff appears to be seeking that this Court enjoin a recently approved asset sale in bankruptcy court, Plaintiff has also failed to sufficiently establish why interfering in that well-established process would be in the public interest. Winter, 555 U.S. at 20. Plaintiff may file a motion for a preliminary injunction, supported with additional evidence explaining the treatment of its alleged claims in relation to the ongoing bankruptcy process relevant to this matter, and must give Defendants notice of this lawsuit as soon as possible.
