Without deciding the merits of Defendants argument, the Courts review of the unopposed motion to dismiss shows Plaintiff has failed to comply with the procedures of the Federal Tort Claims Acts, which would require dismissal from this Court. Plaintiff is given 21 days to refile or file an amended complaint. In future pleading, if any, Plaintiff must respond to Defendants factual and legal arguments. Any future complaint should show that Plaintiff has either complied with or does not need to comply with the Federal Tort Claims Act. Failure to replead with 21 days may result in dismissal with prejudice. The motion hearing and initial status conference previously scheduled for 04/27/2020 at 1:30 p.m. are vacated and off-calendar.
