Walter. The Court finds the issues raised by Defendant in the Motion to Dismiss are more appropriately resolved on a motion for summary judgment. In addition, although the Court highly doubts that Plaintiff will be able to establish the requirements for class certification, the Court finds that the issues raised by Defendant in the Motion to Strike, albeit persuasive, are more appropriately raised in an Opposition to Plaintiff's anticipated Motion for Class Certification. Accordingly, Defendant's Motion is DENIED. (lom)
