(IN CHAMBERS) ORDER RE FIRST AMENDED COMPLAINT FOR DAMAGES (DKT. #11 ) by Judge John A. Kronstadt: On 6/9/2020, Plaintiff filed a First Amended Complaint for Damages against Defendants as well as 10 "Doe" Defendants. Dkt. 11. Because more than 21 days have passed since the filing of the initial Complaint, Plaintiff is not currently authorized to amend "as a matter of course" pursuant to FRCP 15(a)(1). However, because there is no evidence on the docket that Plaintiff has served any Defendant, no prejudice would result from the filing of a FAC. Therefore, in the interest of party and judicial efficiency, the FAC is acceptednotwithstanding that it was not timely filed. Plaintiff shall serve all Defendants consistent with the Local Rules and file a proof of service as to each Defendant on or before 6/26/2020. If a proof of service, which indicates proper service in full compliance with the federal rules, is not filed for each Defendant by 6/26/2020, the Defendant(s) will be dismissed. If no proof of service is filed by 6/26/2020, the matter will be dismissed for lack of prosecution and failure to comply with court orders. (jp)
