ORDER RE REQUEST TO PROCEED WITHOUT PREPAYMENT OF FILING FEES by Judge R. Gary Klausner that the request to Proceed Without Prepayment of Filing Fees #2 is hereby DENIED. IT IS RECOMMENDED by Magistrate Judge Pedro V. Castillo for the following reasons: (1) Frivolous, malicious, or fails to state a claim upon which relief from a defendant immune from such relief. (2) Leave to amend would be futile. (3) Complaint is grossly untimely; barred by Heck v. Humphrey, 512 U.S. 477 (1994). (4) Plaintiff alleges that he was "illegally committed" pursuant to his 1997 preliminary hearing and 1998 conviction because his criminal complaint was unsigned.
