Kronstadt: In light of the parties' Notice of Settlement #30 , the Court orders that this action is dismissed without prejudice. The Court retains jurisdiction to vacate this Order and to reopen the action within 30 days from the date of this Order, provided, however, any request by any party(ies) that the Court do so, shall make a showing of good cause as to why the settlement has not been completed withing the 30-day period, what further settlement processes are necessary, and when the party(ies) making such a request reasonably expect the process to be concluded. This Order does not preclude the filing of a stipulation of dismissal with prejudice pursuant to Frcp 41, which does not require the approval of the Court. Such stipulation shall be filed within the aforementioned 30-day period, or by such later date ordered by the Court pursuant to a stipulation by the parties that conforms the requirements of a showing of good cause stated above. ORDER granting in part #10 . None of the reasons offered by defense counsel are sufficient for a thirty day adjournment. First, regardless of the status of settlement discussions, this Court does not adjourn or extend matters based on such discussions as the parties are free to settle at any time. Second, counsel's quarantine status is irrelevant since this hearing is going to be held by video or telephone. Third, plaintiff has alleged dissipation of assets and irreparable injury and defendant's letter does not even attempt to refute that. Fourth, counsel's reference to a temporary restraining order is inconsistent with the docket of this case, and the Court has received no stipulation containing such relief. Nevertheless, in light of counsel's recent appearance, the Court will adjourn the hearing only to 7/30/2020 at 10:45 am and will be held by telephone.
