(IN CHAMBERS) ORDER RE PLAINTIFF'S APPLICATION FOR TEMPORARY RESTRAINING ORDER AND FOR ORDER TO SHOW CAUSE RE: PRELIMINARY INJUNCTION (DKT. #12 ) by Judge John A. Kronstadt: The Application is DENIED; provided, however, this is without prejudice to further proceedings on the Motion for a Preliminary Injunction as stated at the conclusion of this Order. For the foregoing reasons, Plaintiff has not shown a sufficient basis for the issuance of either the requested Temporary Restraining Order or the Order to Show Cause. And, it is unnecessary to address the other factors that apply in considering a request for such relief. However, in the interest of judicial and party efficiency, a hearing on the motion for a preliminary injunction is scheduled for 12/14/2020. Prior to that hearing, the parties may engage in focused discovery on an expedited basis. Thereafter, on or before 11/6/2020, Plaintiff shall file a supplemental brief, not to exceed 10 pages, that addresses the issue of standing raised by Defendants (Dkt. 17 at 7-8) and any new evidence that Plaintiff contends is material to the Motion. On or before 11/13/2020,Defendants shall file any supplemental opposition, not to exceed 1O pages. Upon the filing of these briefs, or if Defendants do not file a timely opposition to any timely brief filed by Plaintiff, a determination will be made whether the Motion will be taken under submission without a hearing pursuant to L.R. 7- 15.
