ORDER DENYING LEAVE TO PROCEED WITHOUT PREPAYMENT OF FILING FEE AND DISMISSING ACTION WITHOUT PREJUDICE by Judge John F. Walter. Plaintiff's failure to exhaust his administrative remedies before proceeding to this Court precludes this action from proceeding. As a result, dismissal is warranted, albeit without prejudice. For the same reason, leave to proceed without prepayment of the filing fee is not warranted. Accordingly, for the foregoing reasons, it is ORDERED that: the Request is DENIED; and the Petition shall be DISMISSED WITHOUT PREJUDICE (efc)
