MINUTE (IN CHAMBERS) ORDER RE: SERVICE OF COMPLAINT by Magistrate Judge Michael R. Wilner. IT IS HEREBY ORDERED that: 1. The Complaint will be filed. Plaintiff will be authorized to serve the Complaint on the following defendants in his / her individual capacity only: a. April 2, 2020 incident Correctional Officer Smith b. July 11, 2020 incident Correctional Officers Castellanos, Martinez,Deras, and Serrano c. September 6, 2020 incident Correctional Officer Dotyd. September 7, 2020 incident Correctional Officer Mendez e. September 30, 2020 incident Correctional Officers Doty and Castellanos. The Ninth Circuit requires that pro se litigants be given an opportunity to amend unless it is clear that the deficiencies cannot be overcome. Lopez v. Smith, 203 F.3d 1122 (9th Cir. 2000). Therefore, Plaintiff may attempt to amend his complaint. Plaintiff may file a First Amended Complaint by or before December 15, to attempt to remedy the deficiencies discussed. ORDER RE REQUEST TO PROCEED WITHOUT PREPAYMENT OF FILING FEES by Magistrate Judge Michael R. Wilner. IT IS ORDERED that the Request to Proceed Without Prepayment of Filing Fees is hereby GRANTED. It is further ORDERED that the prisoner-plaintiff owes the Court the initial filing fee of $350.00. An initial partial filing fee of $16.70 (20% of average monthly balance 28 USC 1915(b)) must be paid within 30 days of the date of this order. Thereafter, monthly payments shall be forwarded to the Court in accordance with this order. granting #2 REQUEST for Leave to Proceed without Prepayment of Filing Fee. (vm)
