January 26, 2021 Opinion or Order Filing 16 MINUTE ORDER IN CHAMBERS - COURT ORDER by Judge Percy Anderson. The Court is in receipt of the Second Amended Complaint ("2nd AC") filed by plaintiff Deitsch Plastic Co. Inc. ("Plaintiff") against Gredale LLC ("Defendant"). The Complaint alleges that this Court possesses diversity jurisdiction over this action pursuant to 28 U.S.C. 1332. The Court previously dismissed the original Complaint and First Amended Complaint with leave to amend because Plaintiff failed to adequately allege the Court's subject matter jurisdiction in either of the prior pleadings. (See document for details). Accordingly, the Court dismisses Plaintiff's 2nd AC for lack of subject matter jurisdiction. Therefore, the Court grants Plaintiff leave to amend the 2nd AC to establish federal subject matter jurisdiction. Plaintiff's Third Amended Complaint, if any, shall be filed by February 2, 2021. The Court is in receipt of the First Amended Complaint ("1st AC") filed by plaintiff Deitsch Plastic Co. Inc. ("Plaintiff") against Gredale LLC ("Defendant"). The Complaint alleges that this Court possesses diversity jurisdiction over this action pursuant to 28 U.S.C. 1332.
