Filing 7 ORDER DENYING REQUEST TO PROCEED WITHOUT PREPAYMENT OF FILING FEES AND CLOSING CASE by Judge Stanley Blumenfeld, Jr.: On 2/8/2021, the Court DENIED plaintiff's request to file the action without prepayment of the full filing fee with leave to amend. Plaintiff was advised to resubmit the Request to Proceed Without Prepayment of Filing Fees and Complaint with a certified copy of the Trust Account Statement and Disbursement Authorization within 30 days, and failure to do so would result in closure of the case #6 . Plaintiff has failed to submit a timely response. Accordingly, the Request to Proceed without Prepayment of Filing Fees is DENIED and the case is closed. (MD JS-6, Case Terminated.) (gk) |
Filing 6 ORDER RE: IFP APPLICATION AND GUARDIAN AD LITEM STATUS by Magistrate Judge Michael R. Wilner, re APPLICATION for Leave to Proceed In Forma Pauperis #2 . The Court directs Ms. Baker to submit a supplemental statement explaining in more detail her income, expenses, assets, and liabilities. The supplemental statement will be due by February 26. Alternatively, Plaintiffs may decide to abandon the IFP request and simply pay the filing fee. A guardian or parent cannot bring a lawsuit on behalf of a minor in federal court without retaining a lawyer. Moreover, even if the family was to find a lawyer to represent them, the Court has not received any application from Ms. Baker to act as a guardian ad litem for the children. She also may not represent the estate-entity by herself as a non-lawyer. Ms. Baker is directed to inform the Court whether and how she intends to address these problems with advancing the case on behalf of others. (see document for further details) (hr) |
