March 19, 2021 Opinion or Order Filing 15 MINUTE ORDER (IN CHAMBERS) Order Re: Defendant's Notice of Errata [DE #14 ) by Judge R. Gary Klausner. Defendant misinterprets the Standing Order. The Standing Order does require parties using form pleadings in removed actions to file new pleadings that comply with the Federal Rules of Civil Procedure ("Rules") within 30 days of removal. (Standing Order at 2, ECF No. #8 ). But the Standing Order does not displace Rule 81. Rule 81 requires defendants in removed actions to answer, if they have not already done so, within the longest of these periods: (A) 21 days after receiving-through service or otherwise-a copy of the initial pleading stating the claim for relief; (B) 21 days after being served with the summons for an initial pleading on file at the time of service; or (C) 7 days after the notice of removal is filed. Defendant must therefore answer by March 18, 2021 because that is 21 days from when it was first served - the longest of the other time periods. If it fails to do so, Defendant will be in danger of being in default. Plaintiff, though, must also comply with the Standing Order by filing a corrected pleading that conforms with "Rules 7, 7.1, 8, 9, 10, and 11." (Standing Order at 2). If Plaintiff fails to do so by April 4, 2021, the Court may dismiss the case for lack of prosecution and failure to comply with the Court's requirements. See minute order for details.
