According to the Complaint, plaintiff is visually impaired and requires screen-reading software to read website content using his computer. Plaintiff brings this action against defendant based on allegations that defendant's website is not configured to be compatible with screen-reading software that renders the website inaccessible to him. Plaintiff's Complaint contains no class allegations and plaintiff has made no attempt to certify a class. Because this action involves allegations concerning the accessibility of a website, and therefore is not a construction-related accessibility claim, the Court hereby discharges the Order to Show Cause. The Complaint filed in this action asserts a claim for injunctive relief arising out of and alleged violation of the Americans with Disabilities Act ("ADA"), 42 U.S.C. 12010-12213, and a claim for damages pursuant to California's Unruh Civil Rights Act ("Unruh Act"), Cal. Civ. Code 51-53. It appears that the Court possesses only supplemental jurisdiction over the Unruh Act claim, and any other state law claim that plaintiff may have alleged, pursuant to the Court's supplemental jurisdiction.
