Nonparty International Brotherhood of Teamsters (the "Union") applies ex parte for an order allowing it to participate as an amicus curiae in this action by Petitioner William B. Cowen, on behalf of the National Labor Relations Board, for an injunction under Section 10(j) of the National Labor Relations Act, 29 U.S.C. 160(j). Assuming ex parte relief is appropriate, the Court declines to exercise its discretion to permit the Union to participate as an amicus curiae. The Union represents that it has a unique perspective on these proceedings, and it contends its appearance in this matter will aid the Court in the determination of the issues presented to it. (Appl. 6.) The Union presents these arguments without supporting facts. The Unions proposed brief operates as a late, overlong reply to Respondents opposition brief. TheCourt declines to entertain superfluous paper in this already extensively briefed action. The Union does not convincingly demonstrate how its participation in this action would be useful to the Court. The application is denied. (lc) |
