The Court hereby discharges the September 15, 2021 Order to Show Cause re Procedural Defect in Removal (the OSC) issued in this case. See Docket No. 12. Plaintiffs Santos Vasquez and Amparo Vasquez (Plaintiffs) did not move to remand based upon any procedural defect in the removal, so any such procedural defect has been waived. See 28 U.S.C. 1447(c). Although Plaintiffs did assert in their response to the OSC that diversity jurisdiction over the action is lacking, the case was not removed to this Court based upon diversity jurisdiction, but instead upon federal question jurisdiction. See Docket No. 1, 2-6. Plaintiffs' concern about subject matter jurisdiction is therefore misplaced. (lom)
