Filing 126 MINUTE ORDER(IN CHAMBERS): ORDER CONFIRMING EARLIER TENTATIVE RULING; DISMISSING CLAIMS ONE THROUGH SIX; VACATING ENTRIES OF DEFAULT; DECLINING SUPPLEMENTAL JURISDICTION OVER CLAIM SEVEN; AND VACATING HEARINGS by Judge George H. Wu. In sum, the Court vacates the entries of default as to Intrivo and Benaron. It confirms as final its January 28 tentative ruling (including with respect to its rulings on the attorneys' fees and anti-SLAPP motions), resulting in a dismissal with prejudice of the first through sixth claims in the FAC. As to Plaintiff's IIED claim, the Court declines supplemental jurisdiction pursuant to 28 U.S.C. 1367(c)(3). The case is therefore dismissed without prejudice as to that claim, such that Plaintiff may re-file only that claim in state court if she so wishes. The hearings set for March 14 and March 17, 2022, in this matter are vacated. See C.D. Cal. L.R. 7-15 (The Court may dispense with oral argument on any motion except where an oral hearing is required by statute, the F.R.Civ.P. or these Local Rules.). Filing 70 MINUTE ORDER IN CHAMBERS by Judge George H. Wu re: Deficiency - Default /Default Judgment (CV-52b) - optional html form, #67 . The Court has received the Clerk's Office's Notice of Deficiency, Default/Default Judgment (Notice," see ECF No. 67) in regards to Defendant Daniel R. Markel. The Notice indicates that an entry of default cannot be entered against Markel because the "Proof of Service is lacking required information." Id. The Court agrees with the Clerk's Office that the proof of service which Plaintiff filed as to Markel does not provide all of the necessary elements to establish adequate service. See ECF No. 29. That document merely states that the process server "served the summons on... Danny UPS Mail CMRA Location, who is designated by law to accept service of process on behalf of... Daniel R. Markel...." Id. That recitation does not satisfy all of the requirements of Cal. Code Civ. P. 415.20 and/or Cal. Bus. & Prof. Code 17538.5. (mrgo) |
