Filing 12 MINUTE ORDER IN CHAMBERS - ORDER RE STANDING AND STATE LAW CLAIMS #9 #11 by Judge Consuelo B. Marshall. On October 19, 2021, the Court ordered Plaintiff to show cause, no later than November 5, 2021, why Plaintiffs claim for "Street Terrorism" under Cal. Penal Code 186.22(a) and Unfair Competitionclaim under 15 U.S.C. 45 should not be dismissed for lack of standing, and why the Court should not decline to exercise supplemental jurisdiction over Plaintiff's state law claims. (Dkt. No. #9 (the "OSC").) Plaintiff filed document titled "Appeal Motion to Dismiss" on November 5, 2021, which appears to be a response to the OSC. (Dkt. No. #11 .) Accordingly, the Court dismisses with prejudice Plaintiff's Cal. Penal Code 186.22(a) claim for lack of standing. Moreover, Plaintiff fails to demonstrate a private right of action exists for a claim under 15 U.S.C. 45. Therefore, the Court dismisses with prejudice Plaintiff's sole federal claim for violation of 15 U.S.C. 45. Accordingly, the Court dismisses without prejudice Plaintiff's remaining state law claims for Ecoterrorism under 18 Pa. Stat. and Cons. Stat. Ann. 3311; Agroterrorism under Mo. Ann. Stat. 574.130; "Tortious Interference With Prospective Economic Advantage"; "Tortious Interference with Potential Economic Relationship"; Unfair Competition under Cal. Bus. Prof. Code 17200; and writ of mandate and "Ministerial Duty" under Cal. Civ. Proc. Code 1085(a). See attached minute order for details. (lom) |
