Plaintiff Jesse Graham moves the Court to enter default against Defendant Cable News Network Inc. on his claim for copyright infringement. The clerk notified the Plaintiff that he did not provide sufficient information regarding Proof of Service to enter default #23 . The clerk subsequently referred this application for default to the Court. In his motion for default, Plaintiff does not provide any information beyond what the process server alleges #22 . Specifically, Plaintiff does not allege that "Joe last name unknown" is a designated agent of Cable News Network Inc., is authorized to accept service on behalf of Cable News Network Inc., or is the type of corporate officer who can accept service under Federal or California law. Despite Plaintiff's claim that Defendant was "served pursuant to Rule 4 of the Federal Rules of Civil Procedure," (id., at 2) service is plainly deficient under California and Federal law because Plaintiff did not serve an authorized agent of Defendant. The Court lacks jurisdiction over Defendant because it has not been served properly. The motion is denied. The Court directs the clerk to deny the entry of default due to improper service of process.
